What is the commission split?
100% commission minus $695 fee per transaction. No monthly fees, no desk fees.
Can I join the real estate division and only do real estate?
Yes, you can.
I am currently DFPI. Do I need to renew as DRE or DFPI?
You do not have to renew as DRE, especially if not yet licensed by DRE. You can remain under DFPI and originate loans but you will be paid as W-2.
What should I do with my CA-DFPI license if I choose to remain 1099 and switch to CA-DRE?
Option 1: Do Not Renew — use the NMLS Do Not Renew Workflow. Option 2: Keep the License — complete CE and renew, but Loan Factory will end your CA-DFPI sponsorship by 12/31/2025 (Approved–Inactive status).
Do LOs in California need to maintain a specific license to stay 1099?
Yes. LOs must maintain an active California DRE License to remain a 1099 Independent Contractor.
Can I be dual-licensed and work under multiple entities?
If you are a DRE-licensed Salesperson (not a Broker), you may only conduct real estate and mortgage activities under one entity at a time.
Will I be able to retain my DBA if I switch brokers?
Salespersons transferring to Loan Factory must use Loan Factory or one of its DBAs. If you are a broker-associate, you can keep your DBA with your current broker.
Is there a mentor requirement for new agents?
Yes. New agents (fewer than 3 transactions in the last 12 months) must work with a mentor for their first 3 total transactions. Experienced agents are exempt.
Do I need to join a REALTOR® Association or MLS to submit offers?
Yes. Before you can write offers or access CAR forms, Loan Factory must register with your local REALTOR® Association.
Does Loan Factory provide E&O insurance?
Yes. Loan Factory will provide E&O coverage in each transaction.
Are we allowed to offer credits to buyers from our commission?
Yes, but only applied to allowable closing costs. No cash rebates outside of escrow. All credits must be disclosed to the lender.
Can we do Property Management or Commercial transactions?
Not at this time.
What is our transaction management platform?
MOSO is developing a transaction management platform — coming soon. In the meantime, agents can use any available platform on the market.
Will there be leads provided?
The marketing team will promote the real estate business. Commission split for leads is TBD.
Who is our point of contact for marketing and compliance?
The marketing team handles collateral. A compliance officer will be designated for escalations.
Will we have an office location?
The corporate office is at 2195 Tully Road, San Jose, CA 95122. Agents are welcome to use the office as needed.
What kind of support is provided?
Moso will host training events and bring in guest presenters (title, insurance, etc.). A mentor list will be available for mentees.
Is there any plan to connect pre-approved Loan Factory clients with RE agents?
Yes — this will be on the product roadmap.
Do I have to be a CA resident to be a licensed real estate agent?
No. See the DRE page for Out of State examinees: dre.ca.gov/Examinees/OutOfState.html
Where are the DRE testing centers?
Sacramento, Oakland, Fresno, La Palma (Orange County), San Diego. See: dre.ca.gov/examinees/
If I have both a REALTOR® and MLO license, where do I enter my real estate license info?
In your profile → Business Information tab → Answer Yes to “Do you have a real estate license?” and fill in the details.
What happens to my active real estate transactions if they don’t close by 12/31/2025?
We recommend closing those transactions with your current broker first before transferring your DRE license over to Loan Factory.
What if I originate a loan under CA-DFPI this year but it doesn’t close until next year?
The loan can still close. Only the commission payment method changes — it will be reported on your W-2 if you’re on W-2 status at closing.
If I was a previous RE Broker, do I have to retake courses to be a salesperson?
Per the DRE, if you’re within 2 years of your expiration date, they will allow you to renew. Otherwise you must start over. See dre.ca.gov/licensees/renewlicense.html
